DMCA Policy

1. Overview

PNG Valley respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond to valid notices of copyright infringement.

If you believe that content on PNG Valley infringes your copyright, please submit a written DMCA takedown notice to our designated copyright agent.

2. Filing a DMCA Takedown Notice

To submit a DMCA takedown notice, please send an email to [email protected] with the subject line "DMCA Takedown Request".

You may also submit your notice via our contact form with the subject "DMCA Takedown."

We will review your notice and respond within 5-10 business days.

3. DMCA Notice Requirements

Your DMCA takedown notice must include the following information:

• Your identification: Full legal name, address, phone number, and email address
• Copyrighted work: Description of the copyrighted work you claim has been infringed, including a URL where the original work can be found
• Infringing content: The specific URL(s) on PNG Valley where the allegedly infringing material is located
• Good faith statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
• Accuracy statement: "The information in this notification is accurate, and under penalty of perjury, I am the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
• Signature: Physical or electronic signature of the copyright owner or authorized agent

4. Counter Notification

If you believe your content was removed in error, you may submit a counter notification. Your counter notice must include:

• Your full name, address, phone number, and email
• Identification of the removed material and its location before removal
• Statement under penalty of perjury that the material was removed by mistake or misidentification
• Consent to the jurisdiction of the Federal District Court in your district
• Your physical or electronic signature

Upon receiving a valid counter notification, we will restore the content within 10-14 business days unless the original complainant seeks a court order.

5. Our Process

When we receive a valid DMCA notice:

• We will review the notice within 5-10 business days
• If valid, we will remove or disable access to the infringing content
• We will notify the user who posted the content
• We maintain records of DMCA notices for legal compliance
• Repeat infringers may have their access terminated

PNG Valley operates under the DMCA safe harbor provisions by responding promptly to valid takedown notices.

6. False DMCA Claims

Filing a false DMCA notice is a serious matter. Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

Please only submit a DMCA notice if you have a good faith belief that the content infringes your copyright.
